TERMS AND CONDITIONS OF SALE AND SERVICE

Sales and service contracts are governed exclusively by the following contract clauses.

DELIVERY TERMS
1) Service and delivery terms are counted from the date of bid acceptance. Not and is attributable to Automation service the client's downtime for the entire time necessary for repair.
Delivery is considered completed from the date on which the goods and is ready for shipment. Not e is also attributable to Automation Service any delay or damage due to the fact and fault of the shipper.

2) The delivery of the goods to the customer in case of sale or after repair and testing will be made using standard packaging, accepted by the carriers, unless otherwise indication of the customer, who must specify the type and mode of packaging desired. Automation service will charge a surcharge for ad hoc packaging.

3) In the event that the client does not pick up the goods from the warehouse at Via Pierre and Marie Curie n. 2/4 Cazzago San Martino (BS) 25046 at the end of the testing, the costs of the storage/deposit and the client shall indemnify and hold Automation service harmless from any liability for storage;

4) In case of default, delay in payment or insolvency, Automation service may request the termination of the contract with the return of the goods; In case of delay in payment of the price Automation service will apply in addition to statutory interest also default interest under the combined provisions of Articles. 1224- 1284 cc. as well as ex Legislative Decree no. 231/2002.

5) In the case of supply with return of the fault, the customer has the obligation to fulfill within 10 days (from the date of receipt of goods by Automation Service Ltd.) to the conditions of the exchange; that is, to the delivery of the faulty device. In the event that the customer fails to comply with the delivery, the contract is configured in the case of sale and therefore Automation service will be forced to apply a surcharge to the total amount;
A recalculation is made even if the module (supplied by the customer) is found to be unrepairable.

6) For purchase order of material without our technical intervention, the diagnosis for the correct identification of faults is the sole responsibility of the customer consequently we do not accept returns.

7) the delivery time specified in the offer is not essential therefore AS is not responsible in the event that the delay is due to force majeure, fact of the third party and / or problems of an administrative

 

WARRANTY
1) Automation service SrL guarantees that the repaired and/or purchased goods will be delivered to the client in perfect working order after testing; In case of any discrepancies and defects Automation undertakes to eliminate the fault under warranty for a maximum period of 24 months from the date of the invoice, excluding consumable goods, without any type of charge and/or dispute and/or claim for compensation for the defective goods by the customer.

1.a) In any case, AS is not obligated to the 24-month warranty in case of poor maintenance of the machine by the principal that resulted in the damage to the device. AS's technicians will reserve the right to inspect the part before the application of the warranty referred to in 1.2) AS's technical intervention necessary to replace a part under warranty is the responsibility of the customer

3) In case of tampering with the warranty seal, the warranty will not be applied and consequently Automation service declines all responsibility for the defect and/or vice of the good.

4) The complaint of the defect must be made peremptorily within and not later than 8 days from the last day of delivery by sending a written notice by PEC or by Fax

5) In any case Automation service will not apply the warranty for all those goods that are normally subject to wear and tear, have not been properly stored, installed, and/or modified and/or tampered with and/or altered and/or inexpertly used by the client and his appointees and/or delegates.

6) Installation operations always require a specialized operator, Automation service is not responsible for damage - even by way of downtime - and/or damage to the materials and/or devices being installed caused by improper installation/maintenance carried out directly by the Customer and/or third parties;
